Faithful readers of this web site know that we've been reporting on an annual Boulder, Colorado tradition for the last few weeks because it involves running, Boulder, Colorado and yes---naked people.

But today we have some more serious news to report.

According to the the local newspaper the Daily Camera:

"Twelve of the runners who streaked the Pearl Street Mall on Friday night wearing nothing but pumpkins on their heads will have to register as sex offenders if they are convicted of indecent exposure.

The 10th year of the Naked Pumpkin Run started as usual — with laughter, beer and a whole lot of pumpkin carving. But the nude run, which has grown in recent years to include well over 100 people, ended with police citing 12 of the streakers for indecent exposure, a Class 1 misdemeanor. Police have warned runners in the past that the activity isn’t legal, but this is the first time officers showed up en masse to enforce the law.

Now the ticketed runners, whose names have not yet been released, will have to register as sex offenders — a scarlet letter that could mark their professional and personal lives for years — if the charge of indecent exposure sticks.

“It’s very nasty,” said Alexander Garlin, a local lawyer who has experience defending sex-related criminal charges. “Over the years, the system, the way of responding to individuals who are called sex offenders, ultimately has become institutionalized. There’s a whole industry around this, and certain critics have charged that the industry is too much one-size-fits-all.”

That is complete BS. Register Sex affenders should be outed for true crimes and labled as such. It a powerful offense which should strike fear when labled as such. Making a bunch of streakers at a run sex offenders unfairly lables them and over time could take the sting away from the term Sex Offender. (Oh, are you a real sex offender or streaker/drunk kid in alley).


What would they do a Bay to Breakers?

Yeah, me too. Damn, I ran the naked mile in Ann Arbor and streaked the quad in Syracuse. As Aces stated above, common sense has been removed. Although, I am sure that some segments of our society would call this deviant behavior, and ask "what about the children?! Who is thinking about the children?!"

The real problem, IMHO, is that the truly predatory sex offenders will scam people successfully - "I know it's hard to believe I have to register as an offender.  I swear, all I did was take in leak outside/streak in a 'naked mile' race.  Nothing truly awful like assault a 5 year old neighbor boy.  By the way, cute kid..."

I have seen too many people endanger their own children's welfare because they fall for those sort of lines from someone who seems "too nice to be a 'real' sex offender".

We have taken common sense out of the police's hands. If they don't follow strict procedure, they can get in trouble and the real criminals sometimes walk. We then tack on plenty of rules and laws without thought about how they might be applied.

I don't blame the police. I blame the nannystate we have asked for and received.

For the record, I have streaked and I have peed in public.  I also wasn't caught.  As long as these people are made aware of the consequences (as it seems they were told by the police that this was illegal), then the risk and accountability is on them. 

Heck maybe the police in Boulder are actually going to start enforcing the law and will raid the pot party that occurs each year.  Or the many other laws that are ignored. 

While I will say the intent of a group of people streaking is different than one person flashing people, it is the same show.  What makes one a crime and one fun?  Intent.  Should we expect police to charge people based upon their perception of the offending parties intent?

I think one of the thing that is being overlooked is that now the county needs to have a prosecutor who is really willing to press ahead with the charges as listed.  

My expectation is that it would probably get knocked down to a simple disorderly conduct and there will be a fine to pay, if anything.  Again, this is where a good defense attorney comes into play.

Do you know in the state of Michigan, if a police officer or DNR officer witnesses me peeing in the woods while hunting, I can be arrested for indecent exposure.

 

Which yes would make me a "sexual offender".

I was thinking during my next race, I may have to go on the side of the road during the run at night.  With police controling traffic, that could be a bad move.  I could be arrested for being a sex offender during an IM...  Crazy.

I am so glad I did not do it.  I talked about it with friends and I was going to do it jsut to see my friends naked.  I am slow so I would have been caught for sure.

Why is nudity so bad?  I really do not get it.

While I totally agree that in this case the "sex offeneder" labels is not deserved, how is 3 (not 1, not 2 but 3) strikes a "knee-jerk reaction".  Should we give criminals may 5 changes.  How about 10.  Yeah after committing 10 crimes we should lock them up.

Agreed. But such laws often have to be created to combat touchy-feely judges who are unwilling to impose sentences equitable sentences to begin with.
