Georgia House Bill 180, the "Three Foot Safe Passing" bill, unanimously passed the House Public Safety Committee last week. The full House will be voting on the bill soon, and its passage is anything but certain. For what it's worth I sent an e-mail.  However, if Georgia Bikes or some other pro-cycling organization doesn't have a condo downtown with a full stocked bar I'm skeptical that our lawmakers will care.  Maybe they'd believe it will save lives just like removing the trees from the roadway to see the beautiful billboards but in this case it's actually true!

The best laws don't mean jack if the public doesn't know about them and observe them. It only helps when something actually does happen, then you might have an easier time with the insurance companies.

I hate to say it but the last post is right.  This law IMHO will do nothing for us but help with insurance and after an accident has happened.  The thing that would possibly make a difference is laying an extra 2-3 foot to one shoulder of a road when resurfaced and not roughing those spaces but along the white line so we have an area to ride.  No matter what laws or space they give us you can not legislate common sense - never will be able to.  the that is not paying attention is gonna get you - unless your lucky or paying attention.

What the driving public really does not understand is that even when we do try and ride as far right or even to the right of the white line of the shoulder, the problem, the road wash and trash accumulates in that area vs cars tires just about where our line is, clear the path.  When I ride inside the white line there is glass, nails, bolts, armidillos, skunks, pick something strange and you can find it there.

FWIW, at least there is reconition there needs to be a 3 ft space, that's a good start.  Be safe.

I agree, but this is significant. From a legal perspective, you have two issues anytime something happens like a car collision - liability and damages. When one party is issued a citation and violation of a statute, this helps establish liability. If that party pays the fine, that constitutes an admission of liablility for which it is very difficult for that party or their insurance company to claim the collision was not their fault. In my experience, citations are not often issued in incidences involving automobiles and bikes. If this law is passed, that may very well change. If nothing else, it will help further etablish liability when a bike is clipped by a passing car.

The general public is unaware of most traffic laws. However, ignorance is not a legal excuse. While this law may have no impact on the number of automobile-bike incidences, particularly in the short-term, it will help when such incidences occur.

It's possible that this legislation could be what's needed for cities and their transportation engineers to implement more bike lanes.
