Subject: Hit by a car: UPDATE
Hey, I'm sure you all are sick of this, but I figured that I should update you on the proceedings. I just got out of an appointment with a specialist, and I won't be needing surgery! My triathlon season is saved. He said I'm healing remarkably quick and that I should just take it easy for the next few weeks as I start exercising again. I'm cleared to do cardio, although I think that I will hold off for another few days because my shoulder is still pretty tender and very swollen. So far, no word yet as to whether or not insurance is going to compensate me for my bike, but obviously I'm hoping so. That's my next and hopefully final project in cleaning up this mess. Well, thanks for all of your support throughout all of this! I'm out.

Holy crap!! Glad to hear you're healing up well.  Sounds like you've got a positive outlook on the whole situation, so I'm sure that's helping.

I have thought about it Jim. I'm not sure if I want to cause a whole lot of grief in that dude's life though. I mean, I'm fine, so really I would just be contacting an attorney to squeeze him dry of any money that I can get. Obviously money isn't a bad thing (it means new tri stuff!) but I don't know if I want to tie this up unless there is something serious that I'm missing?

Glad you're okay, and no surgery. Smart move on taking it easy until your shoulder gets better. You don't want to cause a need for surgery by jumping back in too quickly. Enjoy the relaxation!

Well all of the medical bills are covered; he has been very cooperative. However, I'm not completely sure about the bike because the cops didn't place entire blame on him. They cited me for not having a light on my bike. I had reflectors, was on a well-lit road, wearing bright clothing, and abiding by the rules of the road, but apparently reflectors aren't enough in Provo. I guess there is a law stipulating the you need to have a light on the bike. So they wrote me a ticket. One of the insurance adjusters mentioned compensating me for the bike, but I guess I'm mainly nervous about it because I haven't heard anything about it since. Thanks for the advice, maybe I'll make some calls to see if I am indeed going to receive compensation for the bike, and if not, I'll contact an attorney.

I didn't see your original post detailing the accident, but were you hit at night?  It seems a stupid question but I've heard of stranger things than someone getting a ticket in daytime for not having a light on their bike. 

 BTW, I'm sorry to hear you got hit but I'm glad you're recovering quickly!

Thanks for the well wishes. Yes, I was hit at night. It was around 7:30ish, which is relatively dark in Utah. It was on a very well-lit street though.

OK, I can't ignore this again. Really, I was going to let it go, but it came back and I have to put in my two cents.

You need to take responsibility for NOT riding with a light in the dark. From this post, it appears that you think it's OK that you didn't have a light because it was a well lit street. This is WRONG and as you stated is illegal.

I do hope that you have a good and quick recovery, as I don't wish any accident on anyone, especially not on a bike.

Here's the New York State Law:

  • Section 1236. Lamps and other equipment on bicycles.
    (a) Every bicycle when in use during the period from one-half hour after sunset to one-half hour before sunrise shall be equipped with a lamp on the front which shall emit a white light visible during hours of darkness from a distance of at least five hundred feet to the front and with a red light visible to the rear for three hundred feet. Effective July first, nineteen hundred seventy-six, at least one of these lights shall be visible for two hundred feet from each side.
    (b) No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least one hundred feet, except that a bicycle shall not be equipped with nor shall any person use upon a bicycle any siren or whistle.
    (c) Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, clean pavement.
    (d) Every new bicycle shall be equipped with reflective tires or, alternately, a reflex reflector mounted on the spokes of each wheel, said tires and reflectors to be of types approved by the commissioner. The reflex reflector mounted on the front wheel shall be colorless or amber, and the reflex reflector mounted on the rear wheel shall be colorless or red.
    (e) Every bicycle when in use during the period from one-half hour after sunset to one-half hour before sunrise shall be equipped with reflective devices or material meeting the standards established by rules and regulations promulgated by the commissioner; provided, however, that such standards shall not be inconsistent with or otherwise conflict with the requirements of subdivisions (a) and (d) of this Section.
  • My guess is that most places require a headlight when riding near sunrise or sunset.  I think it's interesting they New York requires a bell or horn, don't think I've seen a bike yet with one of those.  Guess I'll have to think about that one.

    Good to hear you're healing up though.  Time to mount a light on the bike if you're going to ride when it's near dark.

    I don't really see him saying he thinks it's OK that he didn't have a light. He specifically said he got a ticket for it and didn't really complain about getting the ticket, so where's the anger coming from?

    Oh, I'm sure that you were capable of letting it go, you just didn't want to. Sorry, I didn't intend for you to think that I'm not taking any responsibility for the collision, I guess I just didn't get my point across well. I take full responsibility for not riding with a light. I understand now that that wasn't the smartest decision of my life. The fact that I admitted it is illegal seems to be enough evidence that it is wrong; unless you would believe that I think doing illegal things is ok (which I don't). However, I'm not entirely to blame. In fact, I just finshed meeting with his insurance adjustor that says that from the sounds of it he is more to blame than I was because he made the left turn while failing to yield. They (the police and the insurance company) have mutually decided to place 75% of the blame on him and 25% on me, meaning that he was more at fault than I was, but I was still partially at fault because I didn't have a light which I take full responsibility for. Sorry if I wasn't clear before, I hope that I am now.

    I'm sorry if I've offended. I made my post as twice in this thread you pointed out how "well lit" the street was which gave me the impression you didn't think lights were necessary.
