Extreme Veteran 760 Provo, UT (my heart is in Seattle) | Subject: Hit by a car: UPDATE Hey, I'm sure you all are sick of this, but I figured that I should update you on the proceedings. I just got out of an appointment with a specialist, and I won't be needing surgery! My triathlon season is saved. He said I'm healing remarkably quick and that I should just take it easy for the next few weeks as I start exercising again. I'm cleared to do cardio, although I think that I will hold off for another few days because my shoulder is still pretty tender and very swollen. So far, no word yet as to whether or not insurance is going to compensate me for my bike, but obviously I'm hoping so. That's my next and hopefully final project in cleaning up this mess. Well, thanks for all of your support throughout all of this! I'm out. |

I'm not sure if I want to cause a whole lot of grief in that dude's life though. I mean, I'm fine, so really I would just be contacting an attorney to squeeze him dry of any money that I can get. Obviously money isn't a bad thing (it means new tri stuff!) but I don't know if I want to tie this up unless there is something serious that I'm missing? |

Your injuries, Dr's visits, bike, all that stuff should be paid for by the other guy's insurance company. Well all of the medical bills are covered; he has been very cooperative. However, I'm not completely sure about the bike because the cops didn't place entire blame on him. They cited me for not having a light on my bike. I had reflectors, was on a well-lit road, wearing bright clothing, and abiding by the rules of the road, but apparently reflectors aren't enough in Provo. I guess there is a law stipulating the you need to have a light on the bike. So they wrote me a ticket. One of the insurance adjusters mentioned compensating me for the bike, but I guess I'm mainly nervous about it because I haven't heard anything about it since. Thanks for the advice, maybe I'll make some calls to see if I am indeed going to receive compensation for the bike, and if not, I'll contact an attorney. |

It seems a stupid question but I've heard of stranger things than someone getting a ticket in daytime for not having a light on their bike. BTW, I'm sorry to hear you got hit but I'm glad you're recovering quickly! Thanks for the well wishes. Yes, I was hit at night. It was around 7:30ish, which is relatively dark in Utah. It was on a very well-lit street though. |

He specifically said he got a ticket for it and didn't really complain about getting the ticket, so where's the anger coming from? |

Oh, I'm sure that you were capable of letting it go, you just didn't want to. Sorry, I didn't intend for you to think that I'm not taking any responsibility for the collision, I guess I just didn't get my point across well. I take full responsibility for not riding with a light. I understand now that that wasn't the smartest decision of my life. The fact that I admitted it is illegal seems to be enough evidence that it is wrong; unless you would believe that I think doing illegal things is ok (which I don't). However, I'm not entirely to blame. In fact, I just finshed meeting with his insurance adjustor that says that from the sounds of it he is more to blame than I was because he made the left turn while failing to yield. They (the police and the insurance company) have mutually decided to place 75% of the blame on him and 25% on me, meaning that he was more at fault than I was, but I was still partially at fault because I didn't have a light which I take full responsibility for. Sorry if I wasn't clear before, I hope that I am now. |
