Subject: No more adult swim !?
Our local pool just announced that there would be no more adult-swim (10 min every hour) because such a practice was a violation of the Fair Housing Act. Our HOA's logic was 'adult-swim' was in effect age-discrimination. According to the HOA they had 2 options : leave the pool open to everyone all the time - or - have everyone get out of the pool for 10 min each hour. They opted for option #2, "due to safety concerns for children not being equipped to regulate their time in the pool".

Has anyone else's HOA come to this insane conclusion?

It will be interesting to see if they make me get out of the pool for 10 min when I am the only person swimming laps at 0530.

Fair Housing Amendments Act of 1988 ("the Act").

A quick glance at most HOA rules regarding swimming pools will likely uncover at least one rule prohibited by the Act. These include certain rules based on age, restrictions against children wearing diapers in the pool, adult-only pools and adult-only hours or swim times. These rules are discriminatory under the Act as they appear to discriminate against families with children by not providing equal access to the swimming pool to all residents. Over the past decade, a number of court decisions have applied the provisions of the Act to HOA pool rules and regulations. The cases have held that restrictions on children's use of a swimming pool, where those same restrictions do not apply to other adult residents, are prima facie cases of discrimination under the Act.

Why not just write the rule as 10 minutes per hour of "lap" or "swimming only" time? That would eliminate the "age discrimination" issue and in most cases would have the kids or at least the splashing/jumping ones out of the pool. It wouldn't completely help with "safety concerns for children not being equipped to regulate their time in the pool," but that what parents are for (assuming kids can't use the pool without an adult).

I don'tunderstand how that makes it any less dumb but maybe becasue I grew up with it but a 10 min adult swim.  I don't see how it dicriminates against anyone.  No one is saying kids can't use the pool.  They just have to stay out for 10 mins every hour.  Someone got their panties in a bunch because their kid had to sit out for a few mins every hour and sued.  It's rediculous.

I was really hoping someone would tell me this was a bad dream. Guess not. Ugh!

A couple of unbaked thoughts:

How is there are Adult 55+ communities ?

Will moving ratings go away based on the same logic (PG v. R) ?

So, if I start swimming laps at 0530, and I am the only person at the pool, will I have to get out at 0550? I guess the latter question ought to be directed to my HOA.

i avoid my pool in the HOA for that reason and opt to use the local high school

but instead of saying adult only swim, why not designate a time that is "lap swim only" - because that isn't necessarily specifying that adults only are swimming, in fact, I quite regularly have kids swimming laps at the pool with me but it would get rid of some of the splashers

or designate 1-2 lanes in the pool (depending on the size) for laps only, and then the splashers/kids can remain
