Wow...  I went to school at U of Miami and I know exactly where that happened.  Biking in the Miami area is scary, even more so now hearing about this incident...  I hope everyone comes out of the hospital all right.

The guy still deserves some punishment, I guess the civil cases will have to do. I am glad to see he didn't mow them down on purpose.

I am not certain that I understand why the driver was not cited.  When you climb behind the wheel you take on responsibility to operate that vehicle in a safe manner ... be it drunk, on drugs or otherwise impaired.

If you are in a position where you are unable to operate the vehicle safely - such as in a manner where you fall asleep at the wheel - then you are driving impaired.

Everything needs to be fully reconstructed, analyzed then any charges will be filed.  There is a lot of documentation I'm sure than needs to have all the 'i' dotted and 't'  crossed before they jump.  For instance was blood drawn from the driver? Have all the witnesses stories been correlated?, etc.
