I would think, in a time when there is a severe economic downturn, with no bottom in sight, the "homeowner association" which in this case consists solely of the homebuilder, would be a bit more lenient.  As it stands, the homebuilder is already going to face some uphill battle to sell the rest of the properties due to the economy.  And if I was looking in that area, I would NOT buy anything this a-hole is associated with; partly to avoid enriching the jerk and partly because he clearly cannot think like a reasonable human being about extenuating circumstances.

Sadly, this A$$ thinks that the HOME OWNERS association means that he is the dictator of the area.  I'm on my HOA board, and the Association is there to serve the members.  My guess is that the home owners will do more than enough to make that HOA bastard feel like a tool, once they realize what he is trying to do in their name.

What a jerk.

We live directly across the Cul-de-Sac from the HOA president for the place where we rent.  She rarely says "hi" when I see her out in the common area, even when I smile and wave.

But she's quick to send a note to my landlord whenever we don't pull our trash can in immediately after they come by to pick up, or don't trim the fast-growning roses the very second they pop over the fence line.  We work to keep our place looking nice, and of the units in our immediate area, I can only think of one or two where there are any flowers or landscaping other than what the HOA pays for, and ours is one of them. 

Why she can't just come over and say something to us directly rather than involving our landlord is beyond me.  Whenever he gets a letter, he gets all freaked out that they're going to sue him, and starts leaving us worried messages until we reassure him that whatever trivial matter has been taken care of.

I mean, HOAs do good things.  And to be sure, I'm glad when they crack down on the people who feel it's ok to leave trash and junk in view of the common area.  But some people take the power too seriously.

HOA's do seem to be quite the outlet for passive-aggressiveness. But I guess if neighbors just communicated with each other very few HOA's would be necessary at all.

Playing a bit of devils advocate here:

So you're saying that because the husband is stationed in Kuwait that the family has no obligation to fufill their contracts?  The wife had the option to take care of the things for him in his absence.  She chose to move away and 'abandon' the property.  Last time I checked, family obligations fall on the family not just the husband.  Granted, the developer seems like a butt hole, but he IS right.

Since the property had not (assuming) reached a certain %, he is the only HOA.  It had not been turned over to the residents yet.  Right, wrong or indifferent.  I think that there are many other ways to fix the problem, but in the end, the fact that the landscaping is not done = failure to fufill a contract.  Yes or No?

This is a case where being right is just wrong. Yeah, there's a contract, yeah, his wife bailed on the place, yadda, yadda, yadda. Cut the guy some slack; he's serving our country in a war zone. I'm not saying to let him off the hook, but just cut him some slack.

Actually, as piggpen pointed out, the Solders and Sailors Act DOES mean he cannot be penalized for not fulfilling the contract while serving overseas. It is specifically to protect the ENTIRE family, more than just the service member, due to the extreme hardship placed on the family during the service member's absence. So while he cannot entirely walk away from the contract, this azzhat cannot legally go after him until he gets home. The act is there entirely because we have a$$holes like this in business.

Not only that, but let's say this guy earns a modest 50K. He could be earning as little as 24-30K in the Army right now and suffering severe financial hardship. He may not be able to fulfill the contract.

Too bad he was not a Marine... my old 1st Sgt would have pulled together a group of volunteers at the first hint of this kind of issue to finish the landscaping or "deal with the problem". Either way with the Solders and Sailors Act he is covered and I'm sure the negative press he is generating is not doing him any favors.

I saw on cnn.con that volunteers came together got everything donated and the yard landscaped for the soldier.  The soldier's only request was a flagpole which was put up in view of the HOA's home....

God bless those volunteers for stepping up for this soldier!
