I don't post threads very often so hear goes...

I ordered a disc wheel with cassette and tubular tire with a retail value of $1700 and paid $1335 for it on ebay. However, I used to live at apt. 2710 and now live at apt. 2210. Well I accidently put down 2710 as my address.

 So after several days I see that my package has been delievered on June 21st and I noticed it on Thursday the 24th, so I called my apartment complex and talk to "X" to ask them about it and they he says "yeah, we were gonna call you today, you put the wrong apartment number down." I was like "Oh ok, I'll pick it up in the morning." So Friday 8:30 am rolls around the office is closed...by the time I got around to it on Saturday there closed and Sunday same thing. Monday morning I found out someone in apt. office had given it to the person who lives at 2710. 

Everyday this week I had been calling them trying to get them to get in touch with the guy. So tonight I just knocked on the door...and found out he had thrown it away on Friday the 25th. He says it just 2710 on the package and not my name, but that can't be true since "X" knows it was my package with my name on it.

 What should I do? Your comments are appreciated and helpful.

That's a tough one. I don't buy for a minute that he "threw it out". Seems to me that if the apt office was aware of the mistake and was holding it for you, they're responsible for having given it away to the wrong person. You said that you'd been calling all week trying to get the apt office to get in touch with the guy. What did they say was the problem? Had they not called him or had he not responded to them?

Do you have insurance that would cover it? Because you're probably going to have to take someone to small claims court to get your money back. I'd make sure you've got really good records of who you spoke to and when.

And btw, keep in mind that this is a public forum, so it's discoverable.

They said he hadn't responded.

 No I did not have insurance.

 I am about to write all of this down and print copies off and present the situation to the apartment  manager tomorrow morning or on Saturday and if they do not, then yes small claims court.

That is a horrible story, I thought I was going to see some pics of a new wheel. I don't believe he threw it away, that seems very unlikely. Yeah, keep us posted, sorry this happened.

I am working on a formal draft now, I will be up late tonight have a swim tomorrow at 7am.

 I am printing off pictures, decriptions, reciepts, and the delievery process by fedex.

 Thanks for your support! Hopefully, in the avatar I have now...the disc will actually be mine in a few weeks.

Get the police involved.  Seriously, that is outright theft .......... have them come over and take statements from all of you.  Then press charges if possible.  I guarantee it will suddenly "turn up" and not be thrown out.

Also, keep an eye on Ebay to see if a disc shows up all of a sudden.

As a Police Officer I can tell you I have dealt with situations very similar to this. It is on the line between theft and a civil dispute however, I can tell you that a little pressure from the Po Po does wonders for peoples memory with regards to the location of your property.

I would get them (police) involved as soon as you can to increase your chances of recovering your disk. Goood luck and if you have any questions feel free to PM me.

Thanks everyone for your help in concern. The lastest update is I have been keeping in contact with the seller and emailed him with what I found out. He is willing to help me out as well and said he actually put insurance on it against theft and gave me his cell phone number if anybody needs to reach him. That was a big relief. I will contact the police today as well. I also have a demand letter wrote in the amount that I spent. If you would like to take a look at my grammar let me know, because english was one of my hardest subjects

Question: why did the apartment management office deliver the package to the apartment when they new you lived in a different unit?

Do you have a lawyer that could help guide you in the process as it pertains to your local jurisdiction? As the police officer said above, it may turn out being a civil action and not criminal. Always good to get all the "i"s crossed and "t"s dotted... oh wait...

Due to the legalities we have in this world it would be best for me not to post the latest update after calling the P.D. However, I will win this case. I'll let ya know how it goes soon. But is highly unlikely I'll find a sweet deal like that again. (2008 Zipp Speed Shop Disc, Dura-Ace cassette, and tubular tire all for $1335)

Yeah ok, so I talk to a Tyler P.D. lady on the phone tonight about getting my police report. Well I had to tell her my case and she said it was more civil and a no one did anything deliberately. She wasn't very helpful.

"No one did anything deliberately."?????  Did you not call the apartment superintendent and notify him/her of this?  And the answer from that party was "yeah, we were gonna call you today, you put the wrong apartment number down."   If that person was aware that the package was for you but gave it to someone else, then it IS deliberate!

I would start asking about the federal implications of this along the lines of mail theft.  Taking mail that belongs to others is a federal offense. This might get a stronger response from all parties involved.

That's what I was thinking, too. You can't just keep mail that does not belong to you. I remember many years ago the FedEx guy delivered my husband's paycheck to the wrong address. The guy who it was accidentally delivered to contacted me, however, he acted like he wanted a reward for returning it!!!

Your neighbor is a thief. He either has that disc wheel in his apartment or he pawned it or sold it. What did you say to him when he said he threw it out?

were most likey talking someone if not everyone to court if there is not a response or settlement met in a reasonable amount of time. The seller is a cool guy too!!! I'll reccomend him if you want some bike stuff if he has anymore left.
